GENERAL TERMS AND CONDITIONS OF THE ONLINE STORE

These General Terms and Conditions govern the use of the online store available at www.breka.si and define the rights and obligations between the provider and the customer.

The provider reserves the right to amend these terms without prior notice. The terms published at the time the order is placed shall apply to each individual order.

Availability of Information

Before concluding a contract, the provider undertakes to provide the customer with the following information:
– company identity and contact details,
– essential product characteristics,
– prices with clearly indicated VAT,
– delivery costs or notice if such costs are not included in the price,
– payment and delivery conditions,
– validity period of the offer,
– the right to withdraw from the contract,
– the procedure for complaints and warranty claims.

Prices

All prices are stated in euros and include VAT unless expressly stated otherwise.

Prices are valid at the time the order is placed and have no predetermined validity period.

The provider reserves the right to change prices without prior notice.

Ordering Process

The ordering process consists of the following steps:
– product selection,
– order review,
– entering customer information,
– selecting payment and delivery methods,
– order confirmation.

After placing the order, the customer receives a notification via e-mail. Upon confirmation of the order, the sales contract is concluded.

Payment Methods

The provider enables the following payment methods:
– bank transfer to a transaction account,
– payment based on a pro forma invoice,
– other methods if specified in the online store.

The provider reserves the right to determine the payment method for individual orders.

Delivery

Products are delivered by the provider or a contractual delivery partner to the address specified by the customer when placing the order.

Delivery times are informative and may vary depending on product availability.

The provider is not liable for delays caused by force majeure or incorrect information provided by the customer.

Right of Withdrawal

Consumers have the right to withdraw from the contract within 14 days of receiving the goods without stating any reason.

To exercise the right of withdrawal, the consumer must clearly inform the provider of their decision to withdraw from the contract, for example by e-mail to info@breka.si.

Refunds will be made using the same payment method used by the consumer unless the consumer expressly agrees otherwise.

The provider may withhold the refund until the returned goods have been received or until the consumer provides proof that the goods have been sent back.

The goods must be returned undamaged, unused, and in the original packaging, unless this was necessary to establish the nature, characteristics, and functioning of the goods.

The withdrawal period is considered observed if the notice of withdrawal is sent before the expiry of the 14-day period.

The cost of returning the goods shall be borne by the customer unless agreed otherwise.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in cases specified by applicable legislation, especially for:
– goods made according to the customer’s precise instructions,
– goods customized to the customer’s personal needs,
– goods which, by their nature, are not suitable for return.

Complaints and Non-Conformity of Goods

Customers may submit complaints in accordance with applicable legislation.

In the event of non-conformity of goods, consumers are entitled to rights provided under applicable legislation.

Liability

The provider strives to ensure accurate and up-to-date information but is not liable for any errors in product descriptions or technical issues on the website.

The provider is not liable for damage resulting from improper use of products.

Personal Data Protection

The provider processes personal data in accordance with the Privacy Policy published on www.breka.si.

Complaints and Disputes

The provider complies with applicable consumer protection legislation and strives to resolve disputes amicably.

If an amicable resolution cannot be reached, the court with subject-matter jurisdiction in Novo mesto shall have jurisdiction.

Alternative Consumer Dispute Resolution

In accordance with applicable law, Evostil d.o.o. does not recognize any provider of alternative consumer dispute resolution as competent to resolve a consumer dispute that a consumer may initiate under applicable legislation.

Information on European Online Dispute Resolution

The European Online Dispute Resolution platform (ODR) was discontinued on 20 July 2025. Information on alternative dispute resolution bodies is available on the European Commission website:
